The BC Prosecution Service (BCPS) contributes to the protection of society by preparing for and conducting prosecutions diligently and fairly. The BCPS prosecutes offences under the Criminal Code of Canada, the Youth Criminal Justice Act and provincial statutes in the provincial, Supreme and Appeal Courts of British Columbia and in the Supreme Court of Canada. The BCPS provides legal advice to government and police on criminal law matters and develops policies and procedures on issues relating to the prosecution of criminal justice. The Assistant Deputy Attorney General (ADAG) is responsible for the administration of the BCPS, which is divided into Headquarters, Criminal Appeals and Special Prosecutions (CASP) and five regions which are headed by a Regional Crown Counsel.

Criminal Appeals and Special Prosecutions (CASP) is looking for the next Deputy Director in charge of Criminal Appeals.

The Deputy Director in charge of Criminal Appeals is a senior member of the BCPS, a member of the Regional Management Committee and reports to the Director of CASP. This position will perform leadership and management functions, as well as assume administrative and legal duties.

The Deputy Director in charge of Criminal Appeals will lead and provide management oversight in relation to APP1 policy (Appeals by Crown to the Court of Appeal and Supreme Court of Canada), be responsible for appeals in the Court of Appeal and the Supreme Court , evaluate incoming Crown appeal requests, and coordinate with the Director of CASP on Supreme Court of Canada (SCC) interventions, deal with alleged wrongful convictions and the Post-Conviction Review Committee, and provide legal advice in complex matters.

The Deputy Director in charge of Criminal Appeals will be expected to manage his or her own caseload, provide advice to Crown counsel, within and outside CASP and provide legal advice and support to the BC Prosecution Service Management Committee on those issues arising at all levels of court.

CASP is responsible for the following areas of practice:

  • all indictable criminal appeals undertaken to the Court of Appeal for British Columbia and the Supreme Court of Canada, [Criminal Appeals Section];
  • prosecutions involving commercial crime, allegations against police and regulatory offences including environmental and workplace injury and fatality related prosecutions [Commercial, Police, & Regulatory Prosecution Section];
  • organized and major crime prosecutions;
  • CASP is also responsible for providing prosecutorial litigation support to other prosecution offices within the BCPS in respect of constitutional challenges that arise in the trial courts [Prosecution Support Unit];
  • CASP is also responsible for the delivery of legal resources and learning and development opportunities for the BCPS.

    Compensation includes:

    • 20 days of annual vacation to start, increasing over time to 35 days, plus 8 additional earned days off and 2 supplemental leave days

    Qualifications:
    Education and Experience Requirements
    :

    • Membership in good standing with the Law Society of British Columbia or immediate eligibility for call to the British Columbia Bar.
    • Counsel with at least 12 years of criminal law related practice.
    • Counsel with at least 8 years of Crown Counsel experience.
    • Counsel with substantial experience in prosecuting criminal appeals
    • Counsel with substantial experience in conducting complex trials raising difficult legal questions

    Preference may be given to applicants with the following:

    • Experience appearing before the Supreme Court of Canada
    • Experience in the development and delivery of legal education
    • Experience in effectively leading and/or managing legal counsel and professional staff

    Proviso:

    • Travel is a requirement. Transportation arrangements must meet operational requirements of the ministry.
    • Work outside regular business hours may be required.
    • You must submit to and successfully pass the Enhanced Security Screening (ESS) and Criminal Records Review Act (CRRA) check. Security Screening and Criminal Record Review Act checks will be conducted periodically and at least every five years.

    Criminal Appeals and Special Prosecutions (CASP) has one Deputy Director in Charge of Criminal Appeals position available.
    Flexible work options are available; this position may be able to work up to 2 days at home per week subject to an approved telework agreement.
